This application was refused on 25 July 2022 by Department of Home Affairs claiming that the applicant failed to meet the requirement for de facto relationship of minimum timeframe of 12 months before the date of the application and failed to meet the exception as required under Regulations 2.03A of the Migration Regulations (1994) including the requirements under clause 309.211 including marriage among others under clause 309.211 (3) (b) the intended marriage if it takes place be a valid a marriage for the purposes of the s 12 of the Act.
The de facto relationship provided other evidence of relationships like conjugal property in the context of local legislation overwhelmingly proved the relationship and henceforth after hearing. However, 12-month relationships failed to prove Regulation 1.09A whether the conditions of section 5SC exist involving 4 aspects of relationship, the case was decided in favor of the review applicant with the oral decision.
